Q         Do you remember where you were at the time of the accident?

A         I was in my car at the stoplight. /

Q         Did you have a current driver’s license with you?

A         No, sir.  I left it at home.  It was in my / other car.  I put it there the night before.

Q         What type of license do you have? *  Do you know what / I mean?  Was it a Class C or Class A?

A         I don’t know what that is.  I wear contacts.  I / must wear contacts or wear glasses.

Q         That was my next question.  You were wearing contacts?

A         Yes, sir.  I always have / them on.  I can’t see without them..

Q         Now, going back to * the class of the driver’s license, do you know / what class of driver you are?  Do you have a license to drive a truck?

A         I was driving my pickup / truck that day.

Q         I am talking about a big truck like a tractor-trailer.  Do you have a driver’s license / for something like that?

A         No, sir. *  I have a pickup truck, and it is not even a big one.  It / is just for personal stuff.

Q         Can you drive a bike or a motorcycle?  Does your driver’s license show that you / can drive a motorcycle?

A         I don’t have one of those.  I have never had anything but a car or a / truck. *  Most of the time, I have a pickup truck..

Q         Well, I think it is safe to say that / you have a Class C driver’s license.  Do you have that license with you at this time?

A         Yes, sir.  It / is in my pocket.

Q         Could I have it for just a minute?  I would like * to get a copy of / it.

A         That is no problem.  Let me find it.

Q         Well, when you do find it, just give it to me.  / I will have a copy made while we continue with the deposition.  I should have asked for the driver’s license / right from the start.  The class of driver that you are *  is on the license.  It is on the back, / if I remember.

A         I have it.  Here it is.  This is the new one.  I don’t know where it says / the type of driver.  This is not the one that I had at the time of the accident

Q         That is / fine.  As long as you had a * driver’s license at the time of the accident, then you are okay.  Did / I ask you whether or not your license had been suspended?

A         As far as when the accident happened, the license / was good.  It was suspended a long time ago, but at the time of the accident, it was good.

Q         Did / you have * anybody else in the car with you on that day?

A         No, sir.  I was alone.  It was just / me.

Q         Did you have anything to eat that morning before the accident occurred?

A         I think so.  I eat a meal / around 6 or about that time.  I don’t have a chance to eat while I am at work. *  It is / a long time until the next chance to grab a bite to eat.  I don’t know for sure, but I / think I had something to eat.

Q         When was the last time that you had anything of an alcoholic nature to / drink?

A         I don’t remember.  I don’t drink as much as I did when * I was young.  I have a drink / now and then.

Q         Did you have anything to drink that morning?

A         It was probably coffee.  I like to have coffee / before I go to work.

Q         All right.  But you did not have anything like beer or wine; is that / correct?

A         That is correct.

Q         Did you have anything * of an alcoholic nature the day before the accident happened?

A         I don’t / know.  I would have to think about it.

Q         Just tell us to the best of your memory.  If you remember, / then that is fine.  If you don’t, then tell us that you do not remember.

A         I don’t know for sure.  / I don’t think * so.

Q         Do you recall how much sleep you got the night before the accident happened?

A         The usual / amount, I would guess.

Q         What is that?  As far as the number of hours, how much did you get?

A         Six / or seven hours.  I don’t sleep longer than that.

Q         Do you ever get less sleep than that? *

A         Yes, sir.  Sometimes / I stay up to watch a show or I go out with my wife.

Q         Do you think that you had / had enough sleep the night before the accident?

A         Yes, sir.  I was fine.  I remember that I was in a / good mood so I know that I had had enough sleep.

Q         You were at the stoplight in * your car before / the accident.  Did you have a green light or a red light; do you remember?

A         I had a red light.  / The light had just changed.  I could have been slowing down for the light.

Q         In other words, you had not / stopped at the time of the accident; is that correct?

A         I think * so.

Q         How fast in miles per hour do / you think that you were moving?

A         I don’t know.  I think that I was almost at a halt.  I would / guess two miles per hour.  I was about to stop.

Q         How many other cars were at the red light at / that time?

A         Do you want to know * how many were going the same way as me?

Q         Okay.  That is a / good place to start.  How many cars at the time of the accident were at the stoplight on the same / road as you?

A         I would say that there were two cars in front of me.

Q         How about the cars on / the other * side of the intersection?

A         I don’t know.  The accident happened fast

Q         As much as you can, I don’t / want you to guess, but do you have an idea?

A         I would say two or three.

Q         Two or three cars / were on the other side, to the best of your memory; is that correct?

A         Yes, sir.  I * believe that is / correct.

Q         At the time of the accident, do you remember if any cars were in the middle of the intersection? /

A         No, I don’t believe so.  No, sir.  Traffic had not started for the traffic that was eastbound or westbound.

Q         You / were southbound; is that right?

A         Yes, sir.  I was on the way to * work..

Q         As a matter of fact, you / were late for work on the day of the accident?

A         No, sir.  I was not.

Q         We have your prior deposition.  / I believe that you had said that you were late; isn’t that correct?  If you remember things differently now, please / tell us.

A         I don’t know what I said in * the deposition.  I was due at work at 9 in the / morning.

Q         That is your regular time to start work each day?

A         No, sir.
