Q         Would you state your name for the court and jury.

A         My name is John Davidson.

Q         Is that your full and / complete name?

A         Yes, sir, that is correct.

Q         Do you have a middle name?

A         No, sir.  I do not have one.  / John Davidson is my full name.

Q         Are you married at this time, sir?

A         Yes, sir, I am married.  I have / been married to a wonderful woman for the past five years.

Q         What is the name of your wife?

A         Her name / is Susan.

Q         You have been married for five years.  Do you have any children of this marriage, Mr. Davidson?

A         No, / sir, I do not have any children at this time.  We plan to have one in a year or two. /

Q         Do you remember the car accident that you had back in 1999?  I believe that it was in / March 1999.  Do you remember that accident?

A         Yes, sir.  I remember it very well.

Q         Can you state for / the court and jury what the weather was like on that day, if you can? 

A         As I recall, it was / a very nice day.  It was clear and the sky was blue with very few clouds.

Q         Do you remember whether / or not it had been clear all day long?

A         Yes, sir.  I believe that we had had good weather for / that entire week.

Q         Were there many clouds in the sky at all on that day?

A         No, sir.  As I said, / I believe that it was very clear.  I don’t think that there were many clouds in the sky at all, / if I remember right.

Q         I don’t want you to guess about anything.  If you are sure that the sky was / clear, please say so.  If you are not sure that the sky was clear on that day, please say so.  / We want you to testify to the best of your memory and to the best of your recollection, but we / do not want you to guess about this fact or that fact.

A         Well, it was clear.  I remember that it / was clear on that day.

Q         Now let us talk about the street that you were on when the accident occurred.  / Do you know whether the road was wet in any way?

A         No.  We did not have any rain for about / a week.  It was very warm even for that part of the year, and we did not have enough rain / for the month.  I remember that the paper had said that we were well below the amount of rain that / we should get for that month.

Q         Mr. Davidson, I know that you are trying to give us the best answers / that you can to my questions, but I want you to try to answer each question as it is put / to you.  Do not offer more information or tell us more about the case than you must.  Just answer each / question as I pose it to you.  We will get to each fact or part of the accident in due / time.

A         I am sorry.  I don’t know much about the law and the court.  This is the first time that / I have ever been a part of a trial.  This is all very new to me. 

Q         That is all right.  / Just take it easy.  We are here to ask you questions in order to find out about the case.  We / will try to make it as easy as we can on you. 

A         Thank you very much.  I will try to / give you the answer in the way that you want it.  Could you tell me the question again.  I don’t / think that I remember it at this time.

Q         My last question was about the road that you were on at / the time of the accident.  If I recall, you did answer it.  You said that the road was not wet / in any way on that day.  Is that correct?

A         Yes, sir.  The road was dry and the sky was clear. /

Q         Do you remember if there were many cars on the road at the time of the accident?  I am sorry.  / Let me restate that question.  Do you remember whether or not there were many cars on the road just before / the time of the accident?

A         I would say that it was a normal day.  There were cars on the road, / but there were not too many at that time.

Q         How many cars would you say were on the road at / that time, if you remember?

A         Do you want to know how many were on the road right before the time / of the accident or how many were on the road that day?

Q         Let me break it down for you so / that we can get this very clear.  As you came upon the scene of the accident, how many cars did / you see that were on the same road as you and that were on the same side of the road / going in the same direction as you.  Do you recall how many there were? 

A         I would have to say / that I remember that there was a car or two in front of me and there were a few cars / behind me at that time.
