Ladies and gentlemen of the jury, I would like to thank you very much at this time for your great / patience and great attention to the trial. It has been evident to me that you have done your job as / jurors very well at this time and at all times in this case. It is necessary that we hold jurors / to a very high standard, and I thank you very much for the way in which you have done your / job each day in this case. I am sure that counsel for the plaintiff and also counsel for the defendant / would like to thank you as well. Ladies and gentlemen of the jury, during the trial in this case, we / have started at eight in the morning on almost every day that we have been in session. And except for / certain brief periods of time, the trial in this case has continued until at least four thirty in the afternoon. Ladies and gentlemen of the jury, I want you to know that we will keep to the same schedule as / we have been, but now, at this time, the trial has been completed in this case. I say that it / has been completed, but what I mean is that counsel for the plaintiff and counsel for the defendant are done / with their part as far as the evidence in this case. Ladies and gentlemen of the jury, it is time / for you to do your job as the judges of the facts in this case. Tomorrow you will begin your / deliberations in this case. Please report in the normal way to this court every morning at the normal time. At / that time, we will send you to the jury room where you will do your job. In other words, you / will conduct your deliberations in this case. Ladies and gentlemen of the jury, your duty, tomorrow, will be to decide / the case. Now if you find from the evidence in this case beyond a reasonable doubt that the defendant did / do the act or acts with which he is charged in this case, then it will be your duty to return / the proper verdict showing that he has been proven guilty beyond a reasonable doubt. However, ladies and gentlemen of the / jury, if you find from the evidence in this case beyond a reasonable doubt that the defendant did not do / the act or acts with which he is charged in this case, then it will be your duty to return / a proper verdict that will show that he has not been proven guilty beyond a reasonable doubt. Also, ladies and / gentlemen of the jury, in this case, it is very important that you know that you can only return a / verdict of guilt if you find from the evidence in this case beyond a reasonable doubt that the defendant did / do the act or acts with which he is charged in this case. Ladies and gentlemen of the jury, if / you have any reasonable doubt at all, then you must return a verdict of not guilty. What that means is / that if you can not say beyond a reasonable doubt that the defendant is guilty, then you must return a / verdict of not guilty. That is the standard that you must follow in this case ladies and gentlemen of the / jury. Beyond a reasonable doubt is a higher standard than preponderance of the evidence. Beyond a reasonable doubt means more / than the greater weight of the evidence. You must be able to say that you believe the evidence has proven / the defendant to be guilty in this case beyond a reasonable doubt. Ladies and gentlemen of the jury, any lateness / on your part by any one of you will delay the court and your function as jurors. Although it is / late in the day, we are going to send you to the jury room at this time, but it is / for the one purpose of deciding who will be the foreman in this case. The foreman will speak for you / if the need arises. He or she will also deliver your verdict to the court when you have come to / a conclusion as to the guilt or innocence of the defendant. Ladies and gentlemen of the jury, while you are / in the jury room you will be able to communicate with the court if you feel the need to do / so. Please have the jury foreman write out any questions that you have and hand them to the bailiff who / will then give them to me. Tomorrow I will read the specific jury charge or instructions to the jury. Ladies / and gentlemen of the jury, at that time I will give you the jury charge as to the law in / this case. Depending on how long it takes me to charge you you will spend the rest of the morning / in your deliberations or you may start in the early afternoon. Lunch will be handled in the normal way and / will be at the normal time. Please do not discuss this case outside of the jury room, even if it / is with your fellow jurors. |
